By using Abilikey (the "Service"), you agree to these terms. If you don't agree, please don't use the Service. They're meant to be short and readable.

What Abilikey is — and is not

Abilikey is a free, read-only reference about workplace and school accommodations. It's provided for general information only and is not legal, medical, psychological, vocational, or HR advice, and not a substitute for any of them. We are not a law firm, medical provider, benefits counselor, or HR consultancy; no attorney–client, physician–patient, or other professional or fiduciary relationship is created by using the Service, contacting us, or generating a letter with our tools. Content may not reflect current law or your circumstances. Accommodation, ADA, and Section 504 decisions are made by employers, schools, and agencies — not by us — and we make no representation about the outcome of any request. Confirm anything important with a qualified professional and the official source before acting; you are responsible for decisions you make based on the Service.

No warranty

In plain terms: we work hard on accuracy, but you use the Service at your own risk and we can't promise it's right, complete, or current. The capitalized text below is the legally operative version:

THE SERVICE AND ALL CONTENT, DATA, AND TOOLS (INCLUDING THE LETTER GENERATOR, API, AND CONNECTOR) ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE OR ITS CONTENT IS OR WILL BE ACCURATE, COMPLETE, CURRENT, RELIABLE, UNINTERRUPTED, ERROR-FREE, OR SECURE. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM US OR THROUGH THE SERVICE, CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

Laws, programs, and products change, and entries may be out of date. "Verified" statuses on products and vendors reflect automated, point-in-time checks of the vendor's website — they are not a guarantee that an item is available, suitable, safe, or endorsed.

Limitation of liability

In plain terms: the Service is free, and our exposure has to match that. The capitalized text below is the legally operative version:

TO THE FULLEST EXTENT PERMITTED BY LAW, ABILIKEY, ITS OPERATOR, AND ANYONE WHO HELPS BUILD OR RUN THE SERVICE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF EMPLOYMENT, OPPORTUNITY, ACCOMMODATION, BENEFITS, PROFITS, GOODWILL, OR DATA, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS — WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND EVEN IF WE WERE ADVISED THAT SUCH DAMAGES WERE POSSIBLE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US TO USE THE SERVICE (WHICH IS ZERO) OR ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions don't allow certain warranty disclaimers or damage limitations, so parts of the above may not apply to you; in that case our warranties and liability are limited to the smallest scope the law allows. These limitations are a basis of the bargain that lets us offer the Service for free.

Intellectual property & attribution

The Service organizes facts from public and openly-licensed sources, including the U.S. Department of Labor's Job Accommodation Network (JAN). Underlying facts aren't owned by anyone; our original summaries, selection, and arrangement are ours. Product, company, and organization names and marks belong to their respective owners. Abilikey is independent and not affiliated with, endorsed by, or sponsored by JAN, the EEOC, or any agency, employer, or vendor referenced. See Sources & rights.

Acceptable use

Use the Service for your own informational purposes. Please don't: present its content as legal advice or an official determination; scrape, overload, or disrupt the Service; or use it to harm others.

API & connector terms

The public API and MCP connector (see Developers) are offered free for lawful, non-abusive use, subject to the following:

Third-party links

The Service links to third-party sites we don't control. We're not responsible for their content, products, or practices.

Termination

We may block or limit access that violates these terms (including abusive automated traffic), and you may stop using the Service at any time.

Governing law & severability

These terms are governed by the laws of the Commonwealth of Virginia and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute relating to the Service or these terms must be brought exclusively in the state or federal courts located in Virginia, and you consent to their jurisdiction. If any part of these terms is found unenforceable, that part will be enforced to the maximum extent permitted and the rest remains in full effect.

Changes

We may update these terms and will revise the date above. Continued use after a change means you accept it.
